It spots the criteria that tip the balance towards EMAS

If you bid for public contracts (art. 94 of Law 9/2017, the Spanish Public Sector Contracts Act, applicable to contracts subject to harmonised regulation), if you need a verified public environmental statement, or if your sector has a specific legal advantage (an initial producer of hazardous waste exempt from the minimisation plan under art. 18.7 of Law 7/2022, or an IPPC/IED installation that can simplify its monitoring under art. 10.3 of Royal Decree 815/2013), the tool flags those criteria as reasons in favour of EMAS.

If there is no EMAS reason, ISO 14001 wins

UNE-EN ISO 14001 applies internationally and requires neither a public statement nor registration with a public authority (MITECO, EMAS/ISO 14001 differences). Without a legal criterion pushing towards EMAS, it is the quicker and sufficient route.

It checks the geographical restriction

EMAS registration of sites located in third countries depends on whether the Member State you apply to offers that route: Regulation (EC) 1221/2009 leaves it to the discretion of each State (arts. 3.3 and 11.1, second paragraph), and in Spain Royal Decree 239/2013 (art. 8.2.d) reserves it for countries with a bilateral agreement. If you operate outside Spain/EU-EEA without such an agreement, the tool recommends a combined route: EMAS for the European sites, ISO 14001 (applicable in any country) for the rest.

It checks environmental maturity

If there are reasons for EMAS but your organisation does not yet have an environmental management system, the tool recommends the combined route: ISO 14001 first as the basis (not a formal requirement of Regulation 1221/2009, but the usual path in practice), and from there the environmental statement, verification and EMAS registration.

Does this tool certify or replace the audit of a verifier?

No. It is an indicative guide to decide where to start. EMAS registration can only be granted through the full process with an ENAC-accredited environmental verifier and the competent body of your autonomous community; Summum Calidad supports the implementation, it does not verify or register.

Why does the result sometimes recommend a combined route?

Because there are two real situations in which EMAS alone is not the complete answer: if your organisation does not yet have an environmental management system (in practice ISO 14001 is implemented first, even though Regulation 1221/2009 does not formally require it), or if you have sites outside Spain/EU-EEA in countries with no bilateral agreement with Spain (art. 8.2.d of Royal Decree 239/2013, within the margin the Regulation leaves to each State in its arts. 3.3 and 11.1, second paragraph), in which case EMAS covers only the European sites and ISO 14001 covers the rest.

Does the tool take my company size into account?

It does not ask for headcount, but it is worth knowing that art. 7 of Regulation (EC) 1221/2009 allows small organisations to request extended deadlines from the competent body: renewal every 4 years instead of 3, and updating every 2 years instead of 1, if the verifier confirms there are no significant environmental risks.

Is the result valid for any sector?

It covers the general legal criteria applicable to any sector. If your activity has very specific environmental regulation (a complex integrated environmental permit, hazardous substances, extractive industry), the recommendation of this tool is a starting point and your particular case needs individual analysis with a consultant.

Does Summum Calidad certify EMAS or ISO 14001?
